This is a Federal Aviation Administration Skywatch incident report dated August 10, 2022, filed by the New York facility (ZNY) and now closed. It describes an Emirates Boeing 777 flying from BQN to Amsterdam at FL330, about 1,050 miles off the Carolinas coast. The crew reported two aircraft ahead with landing lights on, flying in formation in a left-hand racetrack pattern at or above FL400. The report says this looked like a fast jet combat air patrol and that law enforcement was not notified.

The crew observed 2 aircraft North of their position operating in a formation in a North to South racetrack pattern. They appeared to have their landing lights on while operating in a left hand racetrack pattern, 3-5 minutes laps with one trailing the other by 5 seconds. Looks like a fast Jet Cap.
