This Central Intelligence Agency filing is a declaration by Delores M. Nelson, the CIA's Information and Privacy Coordinator, in Bryant v. CIA, Civil Action No. 09-0940 in the U.S. District Court for the District of Columbia. It supports the CIA's motion for summary judgment. It traces Larry W. Bryant's 2008 FOIA request for records of a 1987 FAA meeting on the November 17, 1986 Japanese 747 encounter over Alaska and records of similar airborne UFO encounters. It also describes the fee dispute and the searches the CIA ran. No records of the meeting were found, and three documents from other agencies were referred to them.

On May 20, 2009, Plaintiff commenced this action, alleging that Defendant “failed to grant Plaintiff news media representative status,” '“a fee waiver so as only to have to pay photocopying and reproduction fees,” (Compl., 1[1[ 9 and 10), and for the first time, alleged that Defendant “did not use the level of diligence and good faith to conduct a search.” (1_d_., 1[ 12). 12. By letter dated June 23, 2009, the CIA informed Plaintiff it would reopen his request, granted him news media representative status for this request, and conduct a search for “CIA-received and CIA-generated” records on the following a. “the convening, attendance roster, briefings, minutes, and all other related docmnentation of the 1987 special meeting at FAA“headquarters in Washington, D.C.,” b. “all other similar cases of airbome UFO encounters reportedly occurring since Nov. 17, 1986, to date.” (A true and correct copy of this letter is attached hereto as Exhibit E.) 13.
