This Central Intelligence Agency filing is a declaration by Delores M. Nelson, the CIA's Information and Privacy Coordinator, in Bryant v. CIA, Civil Action No. 09-0940 in the U.S. District Court for the District of Columbia. It supports the CIA's motion for summary judgment. It traces Larry W. Bryant's 2008 FOIA request for records of a 1987 FAA meeting on the November 17, 1986 Japanese 747 encounter over Alaska and records of similar airborne UFO encounters. It also describes the fee dispute and the searches the CIA ran. No records of the meeting were found, and three documents from other agencies were referred to them.

Appropriately trained personnel regularly conduct FOIA and Privacy Act searches of the NCS records system as part of their normal duties. NCS operational files are exempt from FOIA search and review pursuant to the CIA Infonnation Act, 50 U.S.C. § 431. The DS provides the CIA with mission-critical services, including the protection of CIA persormel, security matters generally, facilities, communications, logistics, training, medicalservices, and personnel resources. It maintains records on all current and former CLA employees, whether employed in a contract or staff capacity, as well as other individuals for whom security processing or evaluation has been required. Appropriately trained personnel regularly conduct F OIA searches of the DS records system as part of their normal duties. The DIR Area includes the independent offices that report directly to the Director, and is distinct from the CIA’s four _main directorates (NCS, DI, DS&T, and DS). The DIR Area includes the Office of General Counsel, Office of Inspector General, Office of Congressional Affairs, Office of Public Affairs, Chief Financial Officer, Chief Infonnation Officer, and other entities such as the Office of Diversity Plans and Programs. The DNI Open Source Center is also within the DIR Area. Appropriately trained personnel regularly conduct FOIA searches of the DIR records system as part of their nonnal duties. B. Procedures for Processing FOLA Requests The CIA has established the following procedures for processing FOIA requests.
