This is a July 27, 2021 FOIA response from NASA's Office of Communications to John Greenewald, Jr. It covers records from Leslie Kean's lawsuit against NASA seeking Kecksburg documents. NASA released 207 pages in full, 7 in part and withheld 31, noting that most of the lawsuit case files had been destroyed under records retention rules. The enclosures include court declarations, a 2003 appeal decision ordering a broader search, a 2019 FOIA response, and Stan Gordon's account of the missing NASA fragology files.
. 3 I am also directing, by copy of this letter, that the NASA searches include the additional records you requested for the first time in your appeal letter. This new, broader search for NASA records responsive to your client’s original request may obviate the need to address, at this time, the other issues raised in your appeal letter. After you and your client receive the initial determinations concerning any NASA records located as a result of this new search, you would be free to renew, at that time, your assertions with regard to those records. Based on this review, I reverse the Agency’s initial determination and direct that additional searches of NASA records be conducted in accordance herewith. This is a final determination and is subject to judicial review under the provisions of 5 U.S.C. § 552 (a)(4), a copy of which is enclosed. Cordially, James L.
