This Clinton Presidential Library NSC records folder from January 1998 holds the paperwork behind President Clinton's report to Congress on Presidential Determination No. 97-35, issued September 26, 1997. The determination exempted the Air Force's operating location near Groom Lake, Nevada, from hazardous and solid waste laws that could require disclosure of classified information. The file includes letters to Speaker Newt Gingrich and Senate President Albert Gore, NSC clearance emails, and withdrawal sheets. It also notes that the Kasza v. Browner appeal was dismissed as moot.

This is the third such report during this Administration. The language is consistent with earlier reports with the addition of language noting the 9th Circuit's January 8 ruling that the litigation giving rise to the President's exercise of the exemption is moot.
