This Clinton Presidential Library release holds the National Security Council file for Presidential Determination No. 97-35, which President Clinton signed on September 26, 1997. The determination renewed for one more year an exemption under the Resource Conservation and Recovery Act. The exemption keeps classified information about the Air Force operating location near Groom Lake, Nevada, from public disclosure while Kasza v. Browner is on appeal. The file also contains supporting memos from Secretary of the Air Force Widnall, the Deputy Secretary of Defense and Samuel Berger.

We ask that the exemption OSD/GC RECOMMENDATION: I recommend you send to the President the enclosed memorandum and proposed Presidential Determination. As was true last year, EP A Administrator Browner concurs in this request for exemption, as does the Department of Justice’s Environment and Natural Resources Division, which is defending EPA in the pending litigation. The text of the proposed exemption is the same as that granted last year. It exempts the Air Force s operating location near Groom Lake from any provision of hazardous waste law that might require disclosure of classified information concerning the operating location. It also makes clear that other environmental obligations are not diminished. We ask that the exemption be executed and made effective on (but in all events not later than) September 28, 1997, the one- year anniversary of the previous exemption.
