This Clinton Presidential Library file holds National Security Council tracking records and a January 30, 1997 memorandum from the Deputy Secretary of Defense to President Clinton. The memorandum recommends that the President report to Congress, under section 6001(a) of the Resource Conservation and Recovery Act, the exemption he granted in Presidential Determination 96-54 of September 1996. That exemption protects classified information about the Air Force's operating location near Groom Lake, Nevada. The file also contains draft letters to Speaker Newt Gingrich and Senate President Albert Gore, Jr., and the Federal Register text of the determination, which cites Kasza v. Browner.

* DEPUTY SECRETARY OF DEFENSE k ’ ANNTVT.MXAMY 3 0 JAN 1997 k SUBJECT: Congressional Notification of Presidential Exemption Concerning the Air Force’s Operating Location Near Groom Lake, Nevada The EPA Office of General Counsel and the Department of Justice Environment and Natural Resources Division have reviewed the report and concur with the Department of Defense that this report should be provided. Section 6001(a) requires that you “report each January to the Congress all exemptions from the requirements of this section granted during the preceding calendar year, together with [your] reason for granting each such exemption.” You granted such an exemption on September 28, 1996, in Presidential Determination 96-54, which protects classified information concerning the Air Force’s operating location near Groom Lake, Nevada, from public disclosure.
