This Clinton Presidential Library file of White House and National Security Council records from January 1996 concerns President Clinton's report to Congress under the Resource Conservation and Recovery Act. It contains NSC routing sheets, memoranda from James Baker, Anthony Lake, Patrick Griffin and the Deputy Secretary of Defense, and letters to Speaker Newt Gingrich and Senate President Albert Gore. The letters give notice of Presidential Determination 95-45 of September 29, 1995. That determination exempted the Air Force operating location near Groom Lake, Nevada, from waste laws that would require disclosure of classified information.

I find that it is in the para.mount intera,t of the United States to e.�emot
the United States Air Force's operating location near Groom Lake. Nevada
(the subje<:t of litigation in Kasza v. Browner (D. Nev. CV-S-94-795-PMPJ
and Frost v. Perry (D. Nev. CV-S-94-714-PMP)) from any applicable requi..-e
ment for the disclosure to unauthorized persons of classified information
concerning that operating location- Therefore. pursuant to 42 U.S.C. § 6961(a),
I hereby exempt the Air Force's operating location near Groom Lake. Nevacia
from any Federal. State. interstate or Ioctl provision respecting control and
abatemeot·of solid waste or hazardous waste disposal that would .equire
the disclosure of classified information concerning that operating. lo.:ation
to any unauthorized person. This exemption shall be effective for the full
one-year starutory period.
Nothing herein is intended to: (a} imply thac in the absence of such a
Presidential exemption, the Resource Conservation and Recovery Act {RCR.'\)
or any other provision of law perm.its or r !<1Uires disclosure of classified
information to unauthorized persons: or (b) limit the applicability or enforce
ment of any requ.iremant of law applicable to the Air Force's operating
location near Groom Lake. Nevada. except those provisions. if any, that
would require the disclosure of classified i.c.formation.
The Secretary of the. Air Force· is authorized and d!Iected to publish this
Decemunat!on in the Federal Register.
