This Clinton Presidential Library FOIA release (case 2006-0474-F) contains a White House correspondence tracking worksheet and an exchange of letters from January 1995. On January 18, 1995, documentary producer Samuel M. Sherman asked President Clinton for all government documents, photographs and film about Unidentified Flying Objects and extraterrestrial intelligence. Associate Counsel Marvin Krislov replied on January 27, 1995 that FOIA does not apply to the Office of the President. He concluded that FOIA gave Sherman no statutory right to any such records held there.

See 5 U.S.C. § 552(a)(3). The Office of the President, including the President's immediate personal staff and units in the Executive Office whose sole function is to advise and assist the President, is not an "agency" for the purposes of FOIA. Thus, the White House is not an "agency" for the purposes of FOIA. Consequently, FOIA does not establish a statutory right to the documents, if such documents exist, that you have requested from the Office of the President. The White House Counsel's office has received your request of January 18, 1995. Your request is based on the Freedom of Information Act (FOIA), 5 U.S.C. § 552.
