This is a September 30, 2020 FAA FOIA Program Management Division response to John Greenewald, Jr. of The Black Vault. His February 22, 2014 request (2014-009122) asked for the FAA's FOIA case log for 2013. The FAA released one 176-page record, the FY 2013 FOIA log. It withheld third-party names under Exemption 6. The log lists requests by number, requester, organization, date and subject. Most concern airman files, accidents and enforcement records, and one seeks FAA correspondence with Bigelow Aerospace and the National UFO Reporting Center.
FOIA Program Management Division 800 Independence Avenue, SW Washington, DC 20591 September 30, 2020 Mr. John Greenewald, Jr RE: Freedom of Information Act Request 2014-009122 Dear Mr. Greenewald: This letter responds to your February 22, 2014 Freedom of Information Act (FOIA) request for the following “a copy of FOIA Case Log for 2013” Your request was assigned to the FAA FOIA Program Management Division for processing. The FAA FOIA Program Management Division performed a record search in FOIA NTS, the FAA’s official FOIA tracking system, and found one record (176 pages in total) responsive to your request. At this time, we are releasing 176 pages to you, withholding personally- identifiable information under Exemption 6 of the FOIA. FOIA Exemption 6 We have redacted privacy-sensitive and personally identifiable information under Exemption 6 of the FOIA (5 U.S.C. § 552(a)). Exemption 6 of the FOIA protects information about individuals “in personnel and medical files and similar files the disclosure of which would constitute a clearly unwarranted invasion of personal privacy.” 5 U.S.C. 552(b)(6). When applying Exemption 6, the FAA weighs the privacy interest of an individual against any public interest in the records. The information redacted under Exemption 6 includes the names of third party individuals. The agency has determined that these individuals have a privacy interest in the redacted information, and that there is not an overriding public interest in its release. You have not asserted any public interest in disclosure of this information, and I find that there is none. Accordingly, this information has been redacted pursuant to Exemption 6. No fees are being assessed for processing a response for this request. The undersigned is responsible for this partial denial determination. You may request reconsideration of this determination by writing the Assistant Administrator for Finance and Management (AFN-400), Federal Aviation Administration, 800 Independence Avenue, SW, Washington DC, 20591 or through electronic mail at: FOIA-Appeals@faa.gov.
