This Top Secret study by the Interdepartmental Coordinating Group on Germany and Berlin, dated July 12, 1961, and released by the Central Intelligence Agency, answers NSC Directive No. 58 of June 30, 1961. It sets out courses of action for the Berlin crisis but does not judge their merits. It covers imminent presidential decisions, a three-phase timetable running to January 1, military preparations and mobilization, covert action, economic sanctions, public information, negotiating positions and checkpoint procedures for East German personnel.

The general licenses available for shipments to these destinations cover personal baggage, tools of trade, published technical data, unclassified scientific and educational technical data, motion picture films and non-technical publications.

All exports from the U.S. are under regulatory control. Under those regulations exports take place under "general" licenses or "validated" licenses. General licenses are broad authorities permitting exports under specified conditions without specific individual shipment review by the Department of Commerce. Validated licenses are authorities to export only after individual shipment authorization has been granted

Under this legislative authority and statement of policy the Executive Branch has full powers to impose controls over exports of whatever nature deemed necessary to effectively implement desired

security.

The Export Control Act of 1949 authorizes the President to prohibit or curtail the exportation from the U.S. of any articles, materials or supplies, including technical data. To achieve effective enforcement of such controls the President is also authorized to regulate the financing, transporting, or other servicing of exports and the participation therein by any person. This authority has been delegated to the Secretary of Commerce.
