This is a declaration by Delores M. Nelson, the CIA Information and Privacy Coordinator, dated October 26, 2009. She filed it in support of the CIA's motion for summary judgment in Larry W. Bryant v. CIA, a FOIA suit in the U.S. District Court for the District of Columbia. Bryant had sought records of a 1987 FAA meeting about the November 17, 1986 Japanese flight 1628 encounter over Alaska. The declaration describes the agency's searches, which found no records of the meeting and three documents from other agencies about later airborne UFO encounters.
11 2. 13 Approved for Release: 2025/06/10 C07083377 the CLA declined to accept Plaintiff’s fee waiver denial appeal.5 (A true and correct copy of CIA’s response to Plaintiff’s appeal request is attached hereto as Exhibit D.) On May 20, 2009, Plaintiff commenced this action, alleging that Defendant “failed to grant Plaintiff news media representative status”, “a fee waiver so as only to have to pay photocopying and reproduction fees,” (Compl., ‘l[‘I[ 9 and 10), and for the first time, Defendant “did not use the level of diligence and good faith to conduct a search.” (E, ‘][ 12). By letter dated June 23, 2009, the CLA informed Plaintiff it would reopen his request, granted him news media representative status for this request, and conduct a search for “CIA-received and CLA-generated” records on the following: a. “the convening, attendance roster, briefings, minutes, and all other related documentation of the 1987 special meeting at FAA headquarters in Washington, D;C.”, . b. “all other similar cases of airbome UFO encounters reportedly occurring since Nov. 17, 1986, to date.” (A true and correct copy of this letter is attached hereto as Exhibit E.) By letter dated October 21, 2009, the CLA informed Plaintiff that no records responsive to item (a) above were located and that with respect to item (b), U.S. Government material (not originated by the CIA) was located and has been referred to the originating agencies for their review and direct response to him. 6 Approved for Release: 2025/06/10 C07083377 (b)(3) C|AAct
