This Central Intelligence Agency filing is a declaration by Delores M. Nelson, the CIA's Information and Privacy Coordinator, in Bryant v. CIA, Civil Action No. 09-0940 in the U.S. District Court for the District of Columbia. It supports the CIA's motion for summary judgment. It traces Larry W. Bryant's 2008 FOIA request for records of a 1987 FAA meeting on the November 17, 1986 Japanese 747 encounter over Alaska and records of similar airborne UFO encounters. It also describes the fee dispute and the searches the CIA ran. No records of the meeting were found, and three documents from other agencies were referred to them.

In fact, it is quite common for the number of non-responsive documents to exceed the number of responsive documents. 24. After officers identify and remove any non-responsive documents, they must then review the remaining responsive documents to determine if_ any F OIA exemptions apply, and whether they can reasonably segregate non-exempt information from exempt information. In the course of reviewing documents for exempt information and segregability, officers frequently identify information that must be coordinated with or referred to another CIA component or another agency because the other component or agency originated the information.8 This coordination and referral process itself can be quite time-consuming because other components and agencies have their own missions and FOIA priorities. 25. When all of the components and agencies9 have completed their respective reviews, PIPD professionals incorporate all of the recommendations regarding exemptions, segregation, and release, resolve conflicting recommendations, and ensure that the release or withholding determinations comply with the law and published CIA regulations. Under the direction and supervision of the CIA Information and Privacy Coordinator, a review is then conducted from a corporate perspective on behalf of the entire CIA. A final record copy of each CIA- originated document is produced and a response is provided to the requester. 8 See Exec.
