MEMORANDUM FOR: Director of Security
SUBJECT : Marchetti Tax Disclosure
l. Reference is made to previous memoranda which concern
the interviews of various current/former Office of Security
employees by the Internal Revenue Service, in an attempt to
identify the IRS employee who disclosed taxpayer data to the
Agency concerning Victor Marchetti.
2. On this date, the undersigned received a telephone
call from Mr. Walter Rourke, Internal Security Division, IRS,
who advised that on 14 April 1976 he presented the results of
his interviews thus far to Mr. Robert Andary, Department of
Justice. Mr. Rourke stated he presented these results to
Mr. Andary with the recommendation that no further interviews
be conducted.
3. According to Mr. Rourke, Mr. Andary observed that
Mr. Howard Osborn, former Director of Security, had stated
that he had initially requested that the Marchetti taxpayer
data be obtained, but could not specifically recall the iden-
tity of the individual who obtained the data. Further,
Mr. Edmund X. Klipa, former SAC/WFO, had indicated that he
was not aware that the Marchetti disclosure had occurred,
but that Mr. Klipa had stated that on occasion Mr. Osborn
would task WFO employees with special assignments without
Mr. Klipa's knowledge.
4. Mr. Andary then asked Mr. Rourke if the next step
should involve turning the investigation over to a federal
grand jury, to which Mr. Rourke vigorously objected. Mr.
Rourke apparently told Mr. Andary that the probability for
identifying the IRS individual involved in the Marchetti dis-
closure appeared minimal, even if further interviews were con-
ducted. Further, Mr. Rourke stated that this is not a typical
criminal investigation, in that the information obtained bythe Agency would have been legally available had the Agency
