This Central Intelligence Agency records retirement request, dated 17 October 1980, comes from the Office of Legislative Counsel. It retires 16mm microfilm copies of documents the CIA reviewed in response to House Select Committee on Assassinations inquiries into the deaths of President Kennedy and Martin Luther King. Attached 1983 memos record that a District Court ordered the agency to process this segregated HSCA collection in the Allen v. Department of Defense FOIA suit. SUBJECT : Processing Documents in Allen v. Department of Defense, et al., No. 81-2543 (D.D.C.)

1. This memorandum is to formally advise you that the Agency must, pursuant to court order in the above-referenced FOIA litigation, undertake to process the materials contained in the segregated collection of House Select Committee on Assassinations (HSCA)-related material. Accordingly, appropriate Agency personnel should be allowed access to the segregated collection to the extent necessary to process the material contained therein pursuant to the court's order.

2. On 4 March 1983, the District Court entered a memorandum opinion (Ref. A) in which it rejected the Agency's argument that the segregated collection of HSCA-related material did not constitute "agency records" within the meaning of the FOIA. Although the District Court rejected the Agency's basic position, it did rule that all congressionally-generated materials contained in the segregated collection are not subject to the Plaintiff's FOIA request (Ref. A at 6-11). The District Court also ruled that the Agency could claim appropriate FOIA exemptions on a document-by-document basis. On 3 May 1983, the District Court entered an order denying the Agency's motion for reconsideration (Ref. B). On 20 May 1983, the Solicitor General decided against taking an appeal from the District Court's adverse ruling (Ref. C). Accordingly, the Agency is currently under a legal obligation, by virtue of the District Court's memorandum opinion of 4 March 1983, to process all materials in the segregated collection, except for congressionally-generated materials.
