This Central Intelligence Agency FOIA release, dated September 2006, contains an email from a UFO Magazine columnist to CIA Information and Privacy Coordinator Scott Koch. The columnist gives notice that they plan to sue in federal court over the CIA's refusal to treat them as a news media requester and its denial of search fee waivers. The email quotes Koch's August 28, 2006 letter, which accepts the columnist's appeal after no records on John Joseph McCarthy, Jr. were found.

Central Intelligence Agency (http://www.gwu.edu/~nsarchiv/news/20060614/index.htm) cites current CIA policy/practice that such requester-status rejections are administratively unappealable, I hereby serve notice upon your agency that my attorney has instructions to file suit, as soon as possible, in the U. S. District Court for the District of Columbia to contest this rejection that has led to your agency's unlawful, harmful denial of my past/current/future requests for records-search-fee waivers. To complete the administrative record in this matter, I refer you to the following Internet-based petition by which I'm garnering public support for my formal challenge to your agency's application of arbitrary, capricious, and discriminatory standards violative of my rights under the U.
